Legal Justification
Regulation 72(1)(c) permits the extension of the Contract as the need for the modification has been brought about by circumstances which KCC could not have foreseen when planning for the procurement (including the procurement time period). The extension doesnot alter the overall nature of the Contract and the costs will not exceed 50% of the original Contract value. KCC also has grounds to extend the Contract for reasons of extreme urgency as per Regulation 32(2(c). The same factors make it strictly necessary to extend the Contract for reasons of extreme urgency brought about by events unforeseeable by KCC.
