Description

Jisc Services Ltd is seeking to enter into contract with ProQuest LLC to offer our members the opportunity to access online content. The service is being contracted on behalf of our members; not for Jisc's own use. The contract will be for 3 years.

ProQuest UK and Ireland Historical Newspaper Collection is a historical newspaper archive that includes leading British and Irish titles: The Guardian 1821-2003; The Observer 1791-2003; The Irish Times 1859-2012; The Weekly Irish Times 1876-1958; The Scotsman 1817-1950. … Additional information: The contract value is an estimate based on the aggregate sum of the licence fees that will be paid to the supplier by Jisc member institutions over the three year term of the contract. Jisc itself makes no payment to the supplier for this service.

Legal Justification

The supplier is the rightsholder to the IP of the content and the sole supplier of this unique resource. Therefore Jisc is clear that the arrangement falls within the protection of exclusive rights, including intellectual property rights, contained within Regulation 32 (2) (b) (iii) of the Public Contracts Regulations 2015, permitting Jisc to enter into the direct award.
