Legal Justification

he Fast Air Support Team (FAST), part of the UK Ministry of Defence, intends to award a contract for the supply of a five year package of software licences and capability and functionality development in relation to the Typhoon Off-line Mission Data Evaluation Tool (OMDET), which is used in connection with the Typhoon Defensive Aids Sub-System (DASS), to Leonardo UK Ltd. The contract will have a total value of £2.5m. In accordance with Regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 (as amended) for technical reasons. This is because Leonardo UK Ltd is the original designer and manufacturer of DASS and OMDET, is the only supplier of the OMDET software licences and the only supplier which has the knowledge, know-how and technical expertise in relation to OMDET and DASS required to undertake capability and functionality development and qualify and certify the safety and conformance of OMDET to maintain its interoperability with DASS.
