Direct award to Maverick Industries Limited for further construction work to extend existing skatepark which was designed and constructed by Maverick Industries Limited. Additional information: Direct award on the grounds that: a. Maverick Industries Limited as previous designer has intimate knowledge and awareness as to the current structure both in overall design and how this could interface with any extension to that structure as well as the build and integrity of the stake park b. Considerations on insurance cover and satisfying necessary risk assessments for the works

Legal Justification

The contract is for Works contract and below threshold at £200,000. The Town Council has jurisdiction to waiver its Financial Regulations to engage direct awards for below threshold, and the justification for this was on the grounds that: a. Maverick as previous designer has intimate knowledge and awareness as to the current structure both in overall design and how this could interface with any extension to that structure as well as the build and integrity of the stakepark b. Considerations on insurance cover and satisfying necessary risk assessments for the works Therefore in line with Regulation 32 (Use of the negotiated procedure without prior publication) of the Public Contract Regulations the Council has deemed that Regulation 32 b (ii) applies - competition is absent for technical reasons
