Description
The Dismounted Close Combat Team (Soldier Training and Special Programmes- UK MOD) intends to place an enabling framework contract with NSAF Limited (Heckler & Koch UK & H&K Gmbh )for the provision of support services in respect of the in-service fleet of H&K weapons . The contract will be for a 5-year period and will include the provision of a technical support service and the procurement of additional in-service equipment if required
Total Quantity or Scope
This enabling contract will provide a combination of support, supply, repair and will ensure the UK Armed Forces Commands can meet their enduring and future capability needs. This contract will include the provision of a technical support service and enable the procurement of additional in-service equipment, if required.

Legal Justification
In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service is lawful in accordance with Regulation 16 (1) (a) ii of the Defence Security and Public Contract Regulations 2011 for technical and safety reasons. This is because NSAF who are the Original Equipment Manufacturer (OEM) of and the Design Authority (DA) for, all current in service equipment are the only provider who hold the skills, specific experience, technical data and tools needed to fulfil the requirement which involves new testing, new verification and validation ensuring safe implementation and interoperability. To introduce new non NSAF/H&K products into the supply chain and inventory would bring in disproportionate costs, time and technical difficulties to UK MOD The increased level of risk surrounding technical publication and documentation, as well as managing a multi supplier fleet whilst ensuring the safety suitability fit form and function of the products already in service would have a disproportionate impact on the time and cost to the UK MOD
