Development project for the provision of a cryogenic railhead adhesion system to be fitted to Northern Trains Limited's trains intended to provide more reliable and consistent braking in low adhesion conditions.

Total Quantity or Scope

The purpose of this fleet fitment is to provide the rail industry with operational evidence of the effectiveness of cryogenics in mitigating low adhesion of rail vehicles in adverse conditions.

Legal Justification

Award a contract directly as this approach is allowed under the UCR's where restrictions on the use of IPR do not trigger a requirement to conduct a new OJEU-compliant tender process. We believe in this circumstance the following is applicable: Regulation 50.(1) Utilities may use the negotiated procedure without prior call for competition in the following cases- (c) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons - (iii) the protection of exclusive rights, including intellectual property rights* *noting that this applies where no reasonable alternative or substitute exist.
