Legal Justification
East Lothian Council had been advised their appointed contractor from a previous competitive procedure was barred from membership of the Legionella Control Association. Membership of this is a mandatory requirement of the contract and a decision was made to remove the contractor due to this non-compliance. Due to the urgency surrounding this removal a contract was put in place without further competition to the second ranked contractor from the previous Open GPA procurement procedure – Reference No. JAN496721
