Description
The Housing Executive has a Framework Agreement for the provision of Agency Workers as defined by Regulation 3 of the Agency Workers Regulations (Northern Ireland) 2011 (AWRs) to provide cover both for ongoing structural change projects as well as business as usual requirements such as cover for internal secondments, sickness absence, maternity leave or additional workload. Lot Three of this Framework Agreement covers Technical and Professional Specialist roles.

Legal Justification
The Housing Executive awarded a Framework Agreement which contained three Lots, all ending at the same time, at a total value of £71m. This modification is in relation to Lot 3 as there has been an increase in the estimated usage in this Lot. Therefore the spend on this Lot has increased and will exceed the currently approved £13,109,304 limit. The Housing Executive are estimating that to extend the Framework Agreement, in it's entirety, for the final 12 month period (01 April 2026 - 31 March 2027) Lot 3 could incur additional expenditure of up to £19,500,000.00 This figure would be below the 50% allowable under clause 72 (1) (b) (ii) of the Public Contracts Regulations 2015. To not extend Lot Three for the final 12 month period, in line with the other two Lots of the Framework Agreement, would cause significant inconvenience and substantial duplication costs to both the Housing Executive, service providers and to the affected Agency Workers under this Lot. Please note, the overall Total value of the Framework Agreement of £71m will not be affected by this modification.
Other Information
The initial Framework Agreement Period was for a 2 year period (01 April 2023 - 31 March 2025). The Framework Agreement was extended for a further 12 month period, which currently expires on the 31 March 2026. The Housing Executive has the ability to extend the Framework Agreement for a further 12 month period (potential expiry date of the 31 March 2027).
