Description
This is a Provider Selection Regime (PSR) contract modification notice. This contract has been modified under the urgent circumstances provision of the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. This contract has now been formally modified.

Legal Justification
This contract modification must be made urgently as there would otherwise be insufficient time to run a full, compliant PSR Competitive Process and mobilise a new service before the end of the current contract. Not carrying out the award in this instance would, therefore, be likely to pose a risk to patient or public safety. The reason for the urgency was not foreseeable by and is not attributable to the Relevant Authority. The delay in commencing the upcoming PSR Competitive Process was due to the need to await national guidance regarding NHS 111 contracts, the publication of which was delayed considerably. As stated earlier, this modification only serves to extend the current contract for 12 months, which will allow sufficient (but not excessive) time to complete the upcoming PSR Competitive Process and mobilisation of the new service.

Conflicts of Interest: To safeguard against potential conflicts of interest influencing the procurement process and evaluations, all panel members signed conflict of interest declarations and non-disclosure agreements. Project members and evaluators were informed of their role and the importance of the confidential nature of this procurement. No material conflicts were declared.
