Description
Leeds Stop Smoking Service (LSSS) will be delivered in the community and will engage and support people who smoke to stop smoking. This Service will focus on delivering support for people who smoke with, or at risk of developing a common mental health illness and /or along-term physical health condition (the priority group) and within that, will prioritise working with groups and in areas of the city where smoking rates are higher than average for the city.

Legal Justification
The contract was procured under The Health Care Services (Provider Selection Regime) Regulations 2023 (PSR 2023), and as such a modification is permissible under Regulation 13(1)(d) of those regulations. This provision states: "(1) Subject to paragraph (3), a contract or framework agreement for relevant health care services may be modified during its term without following a new procurement process under these Regulations only where-[...] the modification is attributable to a decision of the relevant authority and both of the criteria in paragraph (2) are met." The criteria set out in Regulation 13(2) of the PSR are: "(a) the modification does not render the contract or framework agreement materially different in character, and (b) the cumulative change in the lifetime value of the contract or framework agreement since it was entered into or concluded is- (i) below £500,000; or (ii) less than 25% of the lifetime value of the original contract or framework agreement when it was entered into or concluded." The Council is satisfied that these provisions have been met as the modification is attributable to the decision of the Council, it does not change the nature of the overall contract and is below the relevant threshold provided in Regulation 13(2) of the PSR 2023. The total cost of the modification for the period will be £75,000.00 and there have been no previous modifications to this contract. The cumulative change in the value of this contract is therefore based solely on this modification and represents a 16% increase.
Other Information
This is a Provider Selection Regime (PSR) intended approach notice. The awarding of this contract is subject to the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. The decision maker (Director of Public Health) is in support of this intent to award and believes that services will provide will support for people who smoke with, or at risk of developing a common mental health illness and /or a long-term physical health condition(the priority group) and within that, will prioritise working with groups and in areas of the city where smoking rates are higher than average for the city. No conflicts of interest were identified as part of this process. It is our intention is to award this contract using the most suitable provider process.
