Legal Justification

In accordance with the Procurement Act 2023, section 43 ,DN Colleges Group is switching to a direct award for Lots 2 and 4 because the competitive tender returned no tenders. The requirement remains necessary to deliver the curriculum at the NLC new build and to commit UK Food Valley funding by December 2025. Schedule 5 The conditions in Schedule 5 paragraph 6 are also met: (a) due to an absence of competition for technical reasons, only a particular supplier can supply the goods, services or works required; and (b) there are no reasonable alternatives to those goods, services or works.
