Description
The purpose of this notice is to publish the Authority's intention to modify the HOCS4/00015 MILITARY PERSONNEL AND VETERANS SERVICE DELIVERY CONTRACT (SDC). The SDC requirement (known during the procurement as the Future Service Delivery Contract (FSDC)) was advertised in the OJEU on 10 April 2018 https://ted.europa.eu/en/notice/-/detail/154104-2018 and contract award published in the OJEU on 21 January 2020 https://ted.europa.eu/en/notice/-/detail/29607-2020 The Contract which commenced on 1 June 2020 and is due to expire 31 May 2027, covers, at a high level: a. A variety of personnel support services for the Royal Navy, Army and Royal Air Force, in the form of Joint Personnel Administration (JPA), which is the MOD’s current Military Payroll, Expenses and HR system, and pensions; and b. The development and maintenance of a range of supporting Information system (IS) applications and elements of IS infrastructure. The aims of the SDC contract included the transformation and modernisation of these services and envisaged the expansion of the contract scope to include services currently carried out in house. More time than originally envisaged is required to complete the transformation and disaggregation programme contracted for, which has also been further impacted by legislative changes during the term affecting pensions. The Authority therefore intends to modify the contract, extending the term by a maximum duration of two years to a new longstop expiry date of 31 May 2029. During this time it is envisaged that any follow-on procurements will be conducted. It is considered that this contract modification is not a material amendment and therefore does not amount to the award of a new contract.

Legal Justification
The services provided under HOCS4/00015 MILITARY PERSONNEL AND VETERANS SERVICE DELIVERY CONTRACT must be maintained with minimal disruption and the contractual transformation programme completed whilst addressing legislative changes to pension payments, requiring a variation of applicable contract milestones and an extension of the term of up to 2 years. The Authority considers that the intended contract modifications do not extend the scope of the contract considerably to encompass services not initially contracted for, or change the economic balance of the contract, and had they been part of the initial award procedure they would not have allowed for the admission of tenderers other than those initially admitted or the acceptance of a different tender; therefore, the modification is not a material amendment and does not amount to the award of a new contract.
