Legal Justification

Under Section 43 of the Procurement Act 23 which permits switching to a Direct Award where no suitable tenders or requests are received. In April 2025 an expression of interest was put out to test the market interest but received a poor response with only three expressions of interest (the incumbent Supplier and two other Suppliers). Out of the three responses received two were assessed to not be suitable. Therefore LB Bromley will utilize Section 43 of the Procurement Act 2023, which permits switching to a Direct Award where no suitable tenders or requests are received.
