Legal Justification

The ICB considers that the modification enables continuity of service provision for the Community service which is integral to supporting the delivery of system wide community service priorities. The ICB also considers that the modification is permitted pursuant to the Health Care Services (Provider Selection Regime) Regulations 2023 under regulation 13 paragraphs (3) and (4). This on the basis that:- Direct award process A was followed for the original award of the contract, and the modification does not render the contract materially different in character. - The publication of a modification notice is required as the modification is attributable to a decision of the relevant authority, and the cumulative change in the lifetime value of the contract since it was entered into, is £500k or more.

Other Information

This is a Provider Selection Regime (PSR) contract modification notice, under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this modification.
