Legal Justification
Due to unforeseen circumstances with their manufacturer as a result of non-compliance to Medical Device Regulation (MRD) moving from IVD to IVDR compliance, Aquilant were granted a reasonable amount of time to successfully rectify this. Having resolved this earlier than anticipated, Aquilant can now commence their participation under Lot 1 of this contract.

The High Court is the arbiter of formal procurement challenges and the review procedures are as set out in the Public Contracts Regulations 2015. Proceedings under the Public Contracts Regulations 2015, are time limited, and any such proceedings must be brought in the High Court.
