Total Quantity or Scope
The provision of Minor Oral Surgery Services (MOSS) across Lancashire and South Cumbria. This service involves the treatment and ongoing management of irregularities and pathology of the jaw and mouth that require surgical intervention by a specialist NHS dental provider. Start Date: 01/09/2026 End Date: 31/08/2028 The approximate lifetime value of the contract is based on the annual recurrent budget for L&SC 2025/26 which is £2,719,199, this budget is inflated on an annual basis to reflect increases in ring fenced allocations. This budget is across 12 providers delivering the service within L&SC. Activity caps will be applied to each MOSS provider to ensure levels of commissioned capacity remain within budget. The ICB are intending to award a contract to existing providers following direct award process C.

Legal Justification
This is a Provider Selection Regime (PSR) intention to award notice. The awarding of this contract is subject to the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the processes as set out in the PSR have been applied and not the provisions of the Public Contracts Regulations 2015 or the Procurement Act 2023. The standstill period begins on the day after the publication of the notice. Representations by providers must be made to the relevant authority by the 28th January 2026. This contract has not yet formally been awarded; this notice serves as an intention to award under the PSR.

The ICB has followed a provider selection process where multiple providers have been awarded a contract for the same service, therefore a single transparency notice has been published listing all the providers. Please note that the intention is for all providers to be awarded a separate contract. The standstill period begins on the day after the publication of this notice. Representations by providers must be made to decision makers by 28th January 2026. These contracts have not yet formally been awarded; this notice serves as an intention to award under the PSR. Written representations should be sent to lscicb.procurement@nhs.net Details of Decision Makers: The recommendation to award the contract via this route has been made by the ICB commissioning leads for the service and was then endorsed at the Primary Care Contracting Sub Committee on the 13/11/2025. The final decision to award the contract was made by the LSC ICB Executive Team on the 25/11/2025. This award is in compliance with direct award route c as there are existing providers for the service and the existing providers are satisfying their original contracts, will likely satisfy the proposed new contracts and the services are not changing considerably. In completion of the service and provider assessment, the relative importance of the key criteria (Quality and Innovation, Value, Integration, Collaboration, and Service Sustainability, Improving Access, Reducing Health Inequalities, and Facilitating Choice, and Social Value) were considered against the current contract specification and the ICB are assured that the providers are satisfying the requirements within the specification in relation to the key criteria. The ICB are also satisfied that the providers meet the basic selection criteria. There were no conflicts of interest identified.
