Legal Justification

Under Regulation 72(1)(b) of the PCRs, contracts and framework agreements may be modified without a new procurement procedure, in certain circumstances, when provision of a service is necessary and was not included in the initial procurement; and where a change of contractor would cause significant inconvenience or substantial duplication of costs. Any modification under this provision must also be below 50% of the original contract value. It is proposed that the current situation meets these requirements for the following reasons: i. The value of the contract from January 2018-September 2025 is a total of £2,350,033. Therefore the proposed modification, which would add £439,032 to the total value, represents an additional 18.7% over and above the current contract value. This is well below the 50% threshold described in the relevant regulation.
