Legal Justification
The Council is relying on 2 justification points as provided for under Schedule 5 of the Procurement Act: 1) Additional or repeat goods, services or works The public contract concerns the supply of goods, services or works by the existing supplier which are intended as an extension to, or partial replacement of, existing goods, services or works in circumstances where— a change in supplier would result in the contracting authority receiving goods, services or works that are different from, or incompatible with, the existing goods, services or works and the difference or incompatibility would result in disproportionate technical difficulties in operation or maintenance. 2) Single Suppliers Due to an absence of competition for technical reasons, only a particular supplier can supply the goods, services or works required and there are no reasonable alternatives to those goods, services or works. Rational for why the above justifications are appropriate: The current system has been in operation for numerous years and is functioning well. The existing system is embedded into current working practices, and the Council has no appetite to change systems at this time. The Council is not purchasing a new system, this contract is for the continued licencing support and maintenance which can only be provided by the supplier. A change in system would incur additional costs to the Council for implementation, training and migration.
