Legal Justification

The Main Contractor undertaking modular construction works and the associated design services entered into administration and has subsequently ceased trading. The intention is to retain and directly appoint the former Main Contractors design team (Norder Design Associates) to complete the design allowing the works to progress to completion. Schedule 5 paragraph 6 of the Procurement Act 2023 applies as Norder Design Associates, having already completed, a significant proportion of the design which needs to be concluded and are therefore the only supplier that can supply and complete the services required. There are no reasonable alternatives for the provision of these services, which are already underway.
