Legal Justification

This direct award is permissible under Part 3, Chapter 3 in conjunction with Schedule 5 paragraph 6 of the Procurement Act 2023 regulations as Zurich are the only insurance provider who offers the per pupil model the Council requires. Discussions have taken place with the other insurers in the market and none of these companies offer or are willing to offer a fixed per pupil cost model with no excess and with the exchange of no technical underwriting information.
