Legal Justification

Due to supplier original design, installation and technical knowledge of the racking systems, it is considered that only Dexion Material Handling Ltd can undertake the required works without introducing unacceptable technical and safety risks. Engaging an alternative supplier would require re‑engineering, recertification or partial replacement of existing racking, resulting in disproportionate cost, delay and risk. On this basis, the Contracting Authority considers that the conditions for a direct award under Section 41 of the Procurement Act 2023, with reference to Schedule 5, 6(b) (only one supplier capable for technical reasons), are satisfied.
