Legal Justification

The award must be made urgently in order to achieve the objectives and outcomes of the contract for the impacted population. The reason for the urgency was not foreseeable by and is not attributable to the relevant authority, delaying the award of the contract to conduct a full application of the regime would likely pose a risk to patient or public safety as this would cause a material and significant delay which would result in non-provision of the service for the population. This will cause delays to assessment and treatment, and has potential for deterioration of those awaiting treatment.

This contract has been modified under the urgent circumstances provision of the Health Care Services (Provider Selection Regime) Regulations 2023.
