Legal Justification
This Contract Variation of the scope of the original contract to extend the service to cover the variation to include Newcastle upon Tyne Hospitals NHS Foundation Trust. It is a permitted Modification Regulation 72(1)(c) of the Public Contract regulations 2015. The extension of the scope is operationally required for cost efficiency and optimum interoperability and the modification satisfies all of the following criteria:(i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; - The Contracting Authority could not have reasonable foreseen the future of the Great North Healthcare Alliance Strategy when procuring the original requirement in 2021. The strategy requires enhanced sharing of information and improved collaborative and operational delivery and associated outcomes.(ii) the modification does not alter the overall nature of the contract; - This modification and incorporation of Newcastle upon Tyne Hospitals NHS Foundation Trust requirements is within the overall nature of the original contract requirements, providing the Trust with a laboratory information management system and supporting services.(iii) the increase in price does not exceed 50% of the value of the original contract or framework agreement. - This modification and incorporation of Newcastle upon Tyne Hospitals NHS Foundation Trust remains within the allowable 50% of the value of the original contract of £11,464,918, which includes permitted extensions. The value of the modification is £4,529,961.

The publishing of this VEAT Notice is intended as a Reg 72(1)(c) transparency notice prior to modification to include the contract variation for Newcastle upon Tyne Hospitals NHS Foundation Trust Equipment and Associated Service requirements into the existing Northumbria Healthcare Facilities Management Contract.This Contract Variation of the scope of the original contract to extend the service to cover the variation to include Newcastle upon Tyne Hospitals NHS Foundation Trust.The contract has not as yet been signed and the Authority intends to wait at least the required 10 day minimum standstill period before signature.
