The Council proposes to directly award a contract using the negotiated procedure without prior publication in accordance with Regulation 33(b)(iii) of the Public Contracts (Scotland) Regulations 2015, on the basis of exclusive rights. The development is being delivered by a single developer with exclusive control of the site and development rights, and no reasonable alternative exists.
