Legal Justification
The modification under Reg 72 (1) (c), meets the following conditions: (i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; An opportunity has emerged to align the replacement Framework with an alternative Framework that runs until 30 September 2027. This alignment presents an opportunity to consolidate demand, reduce duplication and to achieve efficiencies with positive benefits for both EA and the market. This modification would result in an extension of the current framework period until 30 September 2027. EA do not envisage any increase in the value of the Framework, during this extension period. This extension period will ensure service continuity for Libraries NI whilst a new arrangement is put in place, allowing EA opportunity to engage the market as part of the process. EA currently envisage that work on this new process will commence in Q3 2026 with a pre-market engagement exercise. (ii) the modification does not alter the overall nature of the contract; The modification does not alter the nature of the current Framework. (iii) any increase in price does not exceed 50% of the value of the original contract or framework agreement. The modification will not modify the original value of the contract.
