Legal Justification

Team Leidos advocates the use of the Negotiated Procedure without Prior Publication, as outlined in PA23 Schedule 5, Paragraphs 5 to 7. The previous suppliers appointed under contract LSL/DC/0106 are unable to supply following a change to the Ministry of Defence (MOD) specification, which they are unable to meet. Corgi Hosiery Limited is the only supplier currently capable of manufacturing and supplying the stockings in full compliance with the MOD specification. Due to the absence of reasonable alternative suppliers capable of meeting the technical requirements, competition could not be achieved within the required timescales without creating an unacceptable risk to operational continuity of supply. A competitive procurement process to tender these goods has commenced. This direct award purchase is therefore necessary to ensure continuity of supply while competitive tendering is undertaken to award a new contract.
