Legal Justification

Sellafield Ltd intends to award a contract to Stainless Metalcraft Chatteris (SMC) pursuant to Schedule 5 paragraph 6(a) and 6(b) of the Procurement Act. Only SMC is capable of delivering the required services due to technical and operational exclusivity and the absence of any reasonable alternative. The contract relates to the maintenance and associated upgrade activities of Sellafield Ltd‑owned assets that are physically installed, integrated, and operated within the SMC manufacturing facility in support of the 3m³ production line. Due to their location and integration within SMC’s live production environment, only SMC has lawful access, operational control, and the technical capability to safely maintain and service these assets. In accordance with Schedule 5, paragraph 6(a), the services can only be supplied by a particular supplier for technical reasons. In accordance with paragraph 6(b), there are no reasonable alternative suppliers, as no third party can perform the maintenance independently without relying entirely on SMC for access and execution of the services.
