Description

The Authority entered into a contract with Contech International on 04/04/2025 for services in Pakistan following an Open Competition. The contract provided for three extensions of twelve months each to a maximum term to 31/03/2029.A Contact Modification (CM) has now been executed in accordance with Regulation 72(1)(b) of the Public Contracts Regulations 2015. The CM is to extend provision in the Indo-Pacific Region until 31/10/2026 while an Open Procedure under PA23 is conducted and increase the maximum contract value by £750,000 excl. VAT to £5,563,956 excl. VAT.Section 72(1)(b) of PCR 2015 provides for modifications in situations where services additional to those originally anticipated are required i.e. ‘for additional…services…by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor (i) cannot be made for economic or technical reasons…or (ii) would cause significant inconvenience or substantial duplication of costs…’, provided that any increase in price does not exceed 50% of the value of the original contract’The value uplift has become necessary to cover additional activity during FY 26/27. Legal Justification

The value uplift has become necessary to cover additional activity during FY 26/27. The contract has been modified to enable the IHR-SP to utilise the additional funding which has become available. The modification has also been required to extend provision in the Indo-Pacific region until 31/10/2026, while a PA23 Open Tender procurement is being carried out. The CM is permissible under Section 72(1)(b) of PCR 2015 which provides for modifications in situations where services additional to those originally anticipated are required i.e. ‘for additional…services…by the original contractor that have become necessary and were not included in the initial procurement, where a change of contractor (i) cannot be made for economic or technical reasons…or (ii) would cause significant inconvenience or substantial duplication of costs…’, provided that any increase in price does not exceed 50% of the value of the original contract’.

Following Preliminary Market Engagement (UK02: Preliminary Market Engagement Notice https://www.find-tender.service.gov.uk/Notice/072773-2025) planning of a procurement for services in the Indo-Pacific region is in progress and is expected to lead to the publication of a UK04 Tender Notice in Find a Tender during Q2 of FY 2026/2027 advertising an Invitation to Tender for the delivery of a contract for services commencing later in FY 2026/2027. A delay in the commercial process has lead to a need to extend the provision in Indo-pacific region until 31/10/2026
