Description
The current Handbook website is maintained by a third-party Contractor who provides thefollowing services (including but not limited to the following):•publishing, consolidating and updating content on the FCA Handbook website;•ongoing development and technical support to improve the design and/or usability of the website, based on userfeedback;•providing management information to the FCA to enable them to monitor the service;•providing Handbook content to licensees who have an agreement with the FCA that they can use the Handbookmaterial; and•offering a print subscription service (or similar) for subscribed users.The scope of this tender is to secure the services of a successful bidder to create, host, maintain and manage theFCA Handbook solution and provide a range of supporting services to replace the existing services.

Legal Justification
The safe harbour under PCR 2015 Regulation 72(1)(b) applies here the basis that this variation introduces additional services and enhancements not included in the original contract scope but are necessary to maintain continuity and functionality of the FCA Handbook website. Changing the supplier at this stage would be impractical and would cause significant inconvenience and duplication of costs because:o The incumbent supplier already hosts and manages the FCA Handbook platform, and transferring these services to a new provider would require extensive rework, data migration, and integration, resulting in operational disruption and additional expense.o The enhancements are technically linked to the existing solution (See Appendix) and cannot be delivered effectively by an alternative supplier without duplicating work already completed.o The price uplift for these additional services is within the 50% threshold of the original contract value, satisfying requirement under Reg72(1)b
