Description

This is a modification notice relating to provision by 3 specialist hospital providers for Devon patients. All specialist hospital contracts for NHS Devon are currently being actively re-procured via a Direct Award process B, however, the existing contracts have expired prior to this process having been fully concluded and as such, permitted modifications are required to allow for short extensions for 3 existing providers to bridge the gap. In all 3 cases the modifications are to extend the end date by a maximum of 3 months and by no more than either £500,000 or 25% of the existing contract value (all contracts are paid on activity basis so calculations are based on usage to date).

Legal Justification

This contract was due to expire on 01/04/2026. it was anticipated that a DAB process being undertaken jointly with a system partner to re-procure all specialist hospital provision under a DAB process would have concluded by this time. Unfortunately this is not the case and a short extension is required to secure ongoing care for the patients currently in care. the price increase indicated below is the maximum possible across all 3 contracts combined.

Other Information

This is a Provider Selection Regime (PSR) contract modification notice, under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Procurement Act Regulations 2023 do not apply to this award. This contract has now been formally modified. The modification was agreed via the NHS Devon Procurement Oversight Group. No Conflicts of Interest were declared.
