Agreement for multidisciplinary design services for The Vine in Peterborough Central Library. via further competition through CCS Framework RM6165 - Construction Professional Services - Lot 1: Built Environment. ACUA Reference: CPS -1-28948-2023 With funding from DLUHC’s Towns Fund programme Peterborough City Council (PCC) will be developing ‘The Vine’, a new financially self-sustaining library, learning, cultural and commercial offer across two sites in Peterborough City Centre by 2026. This procurement is for a multidisciplinary design team (MDDT) to advance 'The Vine’ project for the Central Library only across the RIBA plan of work stages 1-6.

Legal Justification
1. As the project design brief became clearer during RIBA Stages 1 and 2, it became evident that certain design services would not be required namely: a. Planning Consultant (the scale of refurbishment will proceed under permitted development, and no formal planning permission is required) b. Daylight & Sunlight Consultant (not required given the Central Library Scope of Works - Such consultants are typically required when an external extension, new build, or change of massing risks reducing natural light for neighbours or requires planning approval). c. BREEAM Consultant (not required given the Central Library Scope of Works and the PCC sustainability target being an improved EPC rating only - A BREEAM consultant is strictly required only if the project is tied to a formal planning condition, a landlord’s lease requirement, or a sustainability target). 2. When the opportunity was originally tendered via the Crown Commercial framework it was required that Bidders price for the multi-disciplinary team services listed across all the required RIBA stages based on a two stage Design & Build contract form (albeit the actual form i.e. JCT / NEC was not determined at that time). The Council reserved the right to novate and/or retain MDDT consultants over (what was perceived to be) RIBA Stages 4-7 at the time (as required). RIBA Design Stages 1 and 2 became protracted due to site changes and budget pressures. Also at the time, MHCLG funding requirements dictated that funding be spent by March 2027. There was real concern that an acceptable project could not be delivered in time. A procurement strategy/report was produced during RIBA Design Stage 2 that concluded early contractor involvement was necessary to accelerate delivery of the project, maximise what could be achieved with the available budget, and ensure robust and effective planning for the decant of the library and protection of the archives collection, which would remain insitu during the works. This approach was subsequently endorsed by the MHCLG Delivery Associates Network (DAN) procurement experts and the direct award to Clegg Construction at RIBA Design Stage 3 using the SCAPE framework was approved by PCC Cabinet. Pick Everard design team therefore will be novated to Clegg Construction over RIBA Stages 3-7 as part of the Clegg Construction appointment. During early discussions with Clegg Construction, it became apparent that the Pick Everard Project Management and Quantity Surveyor services would not be required to be novated. The Contractor would be using its own in-house team for these roles. The SCAPE framework advocates use of the NEC4 Professional Services Contract during the pre-construction design stage and the NEC4 Engineering & Construction Contract for the construction stage. Whilst client-side advisors to help manage the contractor during the construction stage were always envisaged by PCC the specialism requirements of NEC 4 were not. PCC has therefore omitted the Project Management and Quantity Surveying services from the contract that will be novated to Clegg Construction. This avoids duplication of costs by retaining these services and enables PCC to separately source the two distinct (and bespoke) roles under NEC of NEC accredited Project Manager and NEC Supervisor. The third role client-side role of a Quantity Surveyor will also be sourced separately because the marketplace can provide quantity surveyors with NEC PM accreditation thereby potentially enabling improved value for money for PCC. These 3 services will be procured in time for Clegg Construction commencing on site. The exclusion of Project Management and Quantity Surveying services still leaves the overall nature of the contract a multi-disciplinary design contract. Pick Everard has also confirmed during discussions over the omission of the Project Management and Quantity Surveying services that there will be no staff eligible to transfer under TUPE.
