Description
Maintenance of gate line installed at TransPennine Trains (TPT) station by the original equipment manufacturer (OEM) of all the ATGs operated by TPT. The services under this contract include preventative and reactive maintenance, fault response and resolution, spare parts provision, system monitoring, ITSO and barcode services.

Legal Justification
The contract can be supplied only by a particular economic operator due to technical reasons. The existing ATG estate across the network has been: Designed, supplied, and installed by Cubic Transportation Systems Ltd Built using proprietary hardware, software, and system architecture Integrated with existing revenue protection, ticketing, and station control systems No reasonable alternative or substitute exists because: The systems are dependent on proprietary components, interfaces, and software owned and controlled by the original equipment manufacturer (OEM) Third-party suppliers do not have access to the necessary: Intellectual property Design specifications Software source code Diagnostic tools Substitution would require wholesale replacement of the gate line systems, resulting in: Disproportionate cost Operational disruption across the network Significant safety and performance risks Interoperability and System Integrity The ATG systems operate as part of an integrated rail and ticketing ecosystem, including: ITSO smartcard infrastructure Central ticketing and validation systems Station operational systems Engaging a supplier other than the OEM would compromise: System interoperability Operational resilience Data integrity and revenue protection capability Conclusion On this basis, the contracting entity considers that the conditions for a direct award on the grounds of technical exclusivity and absence of competition for technical reasons are satisfied.
