Legal Justification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee. Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances: The Public Contracts Regulations (PCR) 2015 set out the conditions for how contract modifications can lawfully be applied under Regulation 72. The grounds proposed for progressing this modification is under Regulation 72 (1)(c) noting all of the following conditions must be fulfilled; 72 (1)(c)(i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; Justification: The Council has experienced a number of unforeseen events such as a higher level of Lift repairs due to vandalism;, total failure of 2 additional lifts and , an increase in follow on works resulting from SAFED testing resulting in the Council consuming the contract value spend at a faster rate than originally anticipated. 72 (1)(c) (ii) The modification does not alter the overall nature of the contract. Justification: The modification is accelerating the contract spend with the Supplier, however the total spend will remain within the original 7 year total contract value. The nature and scope of the contract, including the CPV codes remain the same. 72 (1)(c) (iii) any increase in price does not exceed 50% of the value of the original contract Justification: The total 7 year contract value is not being exceeded but the 5 year (initial 3 and 2 year extension) value is being accelerated to reflect a 33% increase during the first 5 years. The contract will expire 30 April 2029 instead of 30 April 2031.
