Description
FPL delivers and supports all the finance and procurement related business functions for the HSCNI. It is the online system which health and social care organizations started to use in 2011 to administer and process tasks . FPL is a Tier 1 Critical System, these services are the most critical clinical or business services across HSC. A service is considered Tier 1 if a failure of that service will result in a significant operational impact to HSC. Restore of these services are of utmost priority after Tier 0 services are restored; it allows all finance and procurement activities for HSCNI. The contract offers a fully managed service with Service Support being provided by One Advanced, infrastructure and network support provided by their 3rd Party suppliers. Staff and managers who work in all areas of HSCNI will have touch points with FPL. Ensuring that the FPL service is and continues to be available for use by HSCNI staff is critical The system secures all HSCNI data from within the managed service so that all HSCNI organisations can meet their operational and legislative needs. The system has been in place under a compliant contract since 2011, it was a 10 year contract with with the option to extend for 3+2, both extensions were availed of. The decision to award and not extend is that the previous contract had been extended twice and has now expired. BSO no longer, legally have the option to create a further extension.

Legal Justification
Sole Source To ensure continued use of FPL providing critical Finance and Procuremnt services to HSCNI. The decision to direct award and not extend is that the previous contract had been extended twice and has now expired. BSO no longer, legally have the option to create a further extension. The supplier holds IPR over the product. These services will be covered under the EQUIP Programme that is already fully funded and nearing completion. As per Schedule 5 of the Procurement Act, where: "due to a particular supplier having intellectual property rights or other exclusive rights, only that supplier can supply the goods, services or works required." there is no other route to market to provide these services.
