Description
This is a Provider Selection Regime (PSR) contract modification notice. This contract has been modified under the Health Care Services (Provider Selection Regime) Regulations 2023. NHS Essex Integrated Care Board has modified an existing General Dental Services (GDS) contract for the provision of primary dental services, including routine, urgent and preventative dental care, in accordance with NHS dental service requirements, to include Level 2 Endodontics and Periodontics Services for a minimum of two years, and at a maximum for the remaining duration of the contract. The contract was originally awarded 1 April 2006. As a GDS contract, it is in perpetuity, therefore there is no fixed end date. For the purposes of calculating the lifetime contract value in accordance with regulatory and reporting requirements, NHS Essex Integrated Care Board applies a 30-year notional duration, and has therefore has selected an 'end date' of 31/03/2036 at II.2.7. As such, the lifetime value of the original contract is £27,226,133.72 (excluding VAT), calculated on the basis of a 30-year notional contract duration for this open-ended GDS contract, based on an annual value of £906,958.

Legal Justification
This is a Provider Selection Regime (PSR) contract modification notice. This contract has been modified under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 and Procurement Act 23 do not apply to this award. This contract has now been formally modified. It is considered by the Authority that addition of Level 2 Endodontic and Periodontal services does not render the contract materially different in character, as the contract remains a General Dental Services (GDS) contract for the provision of primary dental care. The modification extends the range of dental treatments delivered under the contract but does not alter its fundamental purpose, which continues to be the delivery of NHS dental services to the same patient population within a primary care setting. The additional services fall within the established NHS tiered dental pathway and are designed to be delivered in primary care by practitioners with enhanced skills. They represent an increase in the complexity of services provided rather than the introduction of a new or distinct service line. Endodontic and periodontal treatments are already within the scope of general dental care at a basic level, and this modification builds on that existing clinical foundation. The contract continues to be delivered under the same contractual arrangements, in the same care setting, and to the same cohort of patients, with no change to the delivery model or overall service objectives. As such, the modification constitutes an enhancement of existing services rather than a transformation of the contract’s nature or scope.

The decision to modify the contract was taken by the Director of Commissioning for Primary Care and Neighbourhoods on behalf of NHS Essex Integrated Care Board. No Conflicts of interest were identified. Non-conflicted decision-makers assessed the nature and extent of any declared interests and implemented appropriate mitigation measures, to ensure a fair and transparent decision-making process.
