Legal Justification
Termination of the existing Public Health Medicines Service contract is required due to significant and unforeseen structural changes, resulting in the imminent loss of service provision by the supplier. The loss of pharmaceutical expertise presents a risk to continuity, legality, and patient safety, and continued reliance on the current provider is therefore not viable or proportionate and a Direct Award is essential to maintain continuity of service. Sufficient time was not available for alternative arrangements via competition. The urgent Direct Award is for a short time period, until new arrangements are put in to place.
Other Information
This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR). This contract has been awarded under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Procurement Act 2023 do not apply to this award. Termination of the existing Public Health Medicines Service contract is required due to significant and unforeseen structural change, resulting in the imminent loss of service provision by the supplier.
