Legal Justification
Primary justification - Regulation 88(1)(b) UCR 2016 (Additional services) The modification is required to procure additional services of the same type from the original contractors which have become necessary for the continued delivery of the programme and were not included in the original procurement. This also requires a temporal extension. The conditions for Regulation 88(1)(b) are satisfied as follows: 1. Necessity of additional services Continued provision of environmental survey services is required across all lots under the existing framework. These services are of the same nature as those provided under the existing contract and support ongoing rail infrastructure delivery. The requirement to extend the contract until 31 January 2027 reflects continuity and increased demand over time. 2. Inability to change contractor for economic / technical reasons without major inconvenience or cost duplication The contracting entity has recently procured a replacement contractor, under the SCAPE Utilities Works and Services Framework (Kier Integrated Services Limited ("Kier"))Kier has been appointed to carry out the services. Given this appointment, it would not be feasible to hold a further competitive tender process to make a short-term interim appointment to deliver the additional services prior to the commencement of the replacement contracts with Kier. To do so would cause major inconvenience by delaying the EWR programme. Such an appointment would also involve cost duplication, for example, by having additional contractors incur mobilisation costs, given that Kier will separately be mobilising. Therefore, the only practicable step to deliver the required services is to modify the existing appointment to facilitate this. In addition, the following points highlight the major inconvenience which a change in contractor would cause: Technical integration: Services across lots are interdependent, relying on consistent methodologies, shared datasets, and coordinated outputs. Knowledge continuity: Existing suppliers retain critical environmental baselines, historical data, and site-specific information/knowledge. Operational risk: Replacement would result in, e.g. duplication of surveys and inconsistency in outputs. In addition, the incumbent supplier has established relationships with landowners regarding access. . A change of contractor would therefore result in significant inconvenience and substantial duplication of costs, EWR is putting in place replacement long-term arrangements in respect of this contract via standalone competitive procurement and a call-off through the SCAPE framework.
