Legal Justification
The contract provides broad provisions for the parities to vary the contract, to reduce or add additional services (including reducing or adding to the contract value). These includes where any developments, efficiencies and improvements are identified within the Services during the term of the contract to ensure continuity of the service delivery. The Council has identified the following need for modification of the contract to ensure continuity of the delivery of the services under the contract (a) economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor. (d ) need to support additional activity in line with national and local ambitions on smoking cessation. (c) the modification does not render the contract materially different in character and the modification does not change the value of the contract.

This is a Provider Selection Regime (PSR) contract modification notice, under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award. The proposal is to modify this contract form September 2026. The decision makers were the Director of Public Health and the Lead Consultant in Public Health. They have no declared or potential conflict of interests
