Legal Justification

The University has used OpenRoad and Ingress Software to support a business application that cannot operate without it. The right to use the software is available only from Actian under a subscription licence, and no alternative supplier can provide the required licence. The University therefore intends to make direct award under Section41, relying on the schedule 5 justification that only a particular supplier can supply the required software.
