Legal Justification
Rolls Royce are both the ‘Design Organisation’ the ‘Original Equipment Manufacturer (OEM)’ on the Hawk T1 T2 aircraft engines and have been the Prime Contractor for Engine Support for many years. It has been previously identified under Defence and Security Public Regulations (DSPCR) Regulation 16 as a single source requirement. Market examination shows that the market place has not changed and there are no competitors to Rolls Royce with the capability or experience to take on this contract for Hawk Engine Support and be able to provide the full service from day one. Consequently the contract extension is to be awarded without competition, in accordance with Regulation 16(1)(a)(ii) Defence Security Public Contracts Regulations; Article 28(1)(e) Directive 2009/81/EC
