Legal Justification

The modification does not render the contract or framework agreement materially different in character and the cumulative change in the lifetime value of the contract or framework agreement since it was entered into or concluded is less than 25% of the lifetime value of the original contract or framework agreement when it was entered into or concluded. It is permissible in line with Section 13 - 2A and 2B (ii) of The Health Care Services (Provider Selection Regime) Regulations 2023.

For the avoidance of doubt, the provisions of the Procurement Act Regulations 2024 do not apply to this award. This contract has been formally modified.
