Legal Justification
The modification was urgent due to the ICBs still awaiting NHS England to publish the outcomes of their review or provide any update to the 111 national specification which has delayed the recommissioning process at a regional level. The national reconfiguration of both NHS England and the ICBs has also stalled longer term commissioning plans and significantly impacted on resources. The need to re-procure Non-Emergency Patient Transport Services for the region has also created a significant pressure on resources which as such, the ICBs were faced with an urgent decision relating to the 111 service. NHS 111 is a nationally mandated service and a primary entry point for the public to receive urgent care. Not having this service would lead to more burden to the 999 service and Emergency Departments resulting in delays to critically ill patients receiving the care they need. The modification would provide an adequate window for ICBs to receive further national direction from NHS England, to undertake a regional review of the future specification, and time to conduct a full application of the provider selection regime. The review of the future specification and whether this includes full integration with 999 services, will determine the most appropriate PSR route for the longer-term contract award. These timescales should allow for the option to go out to competition if this is the agreed route, leaving a sufficient period for mobilisation of the future service.

This is a Provider Selection Regime (PSR) contract modification notice. This contract has been modified under the urgent circumstances provision of the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 or the Procurement Act 2023 do not apply to this award. This contract has now been formally modified. This modification was approved by the ICB's CFO. No conflicts of interest were identified.
