Description
The Council relies on Regulation 72(1)(c) Public Contracts Regulations 2015 to modify its pre-development agreement entered into with Bouygues UK following a further competition process under the National Framework for Developer Led Schemes Lot 2b. The agreement relates to the delivery of keyworker housing homes and a new community centre at 177 Abbey Street. The modifications are as follows: - The Council's underwriting to cover additional circumstances in consequence of delays beyond the current programme assumptions due to the Building Safety Act requirements namely (1) unsuccessful grant draw down and (2) the scheme becoming unviable due to increased cost to the project; and - Extension to the lease period from 40 years to 125 years; and - Additional keyworker homes to assist with viability. The Council confirms that the need for modification has been brought about by circumstances which could not have been foreseen specifically the significant delays in processing the Building Safety Regulator's application. The Council confirms that the overall nature of the contract remains the same and that the modification does not increase the price in excess of 50% of the value of the original contract
