Legal Justification
Gladstone MRM Limited is the provider of the Leisure Management System currently in use by the University. The system has been fully operational since approximately 2018 following a compliant tender process and is embedded within the University's systems and operational processes.

The University of Strathclyde has awarded a contract for the Gladstone Leisure Management System and associated services. Gladstone MRM Limited is the provider of the LMS currently used by the University. The software has been fully operational since circa 2018 following a compliant tender process and has become embedded within the University's systems and operational processes. Due to the technical integration of the software and the University's operational reliance on the system, there is no suitable alternative that would provide equivalent functionality without significant disruption. Transitioning to an alternative solution would incur substantial cost, operational risk and service disruption. A Voluntary Ex Ante Transparency (VEAT) Notice was published prior to contract award. Accordingly, the contract has been awarded under Regulation 33(1)(b)(ii) of the Public Contracts (Scotland) Regulations 2015 on the basis that competition is absent for technical reasons.
